1. Definitions

In these conditions, the following definitions apply:

• TrendiMail: the email marketing platform of Trendiwa Netherlands.
• User: any natural or legal person who creates an account or uses TrendiMail.
• Service: all functionalities of TrendiMail, including email campaigns, automations, forms, segmentation, and reports.
• Credits: sending credit for emails within TrendiMail.
• Contacts: persons added to the platform by the user.
• GDPR: European privacy legislation.

2. Applicability

These Terms and Conditions apply to all services, subscriptions, and agreements between TrendiMail and the user.

By creating an account or using TrendiMail, the user agrees to these terms.

3. Services of TrendiMail

TrendiMail offers an online platform for:

• sending email campaigns
• managing contacts
• setting up automations
• collecting subscriptions
• analyzing statistics

TrendiMail reserves the right to modify, improve, or remove functionalities when necessary for the operation or security of the platform.

4. Subscriptions and prices

4.1 Subscription

The user chooses a subscription based on the number of emails that can be sent per month.

All subscriptions include:

• unlimited contacts
• all features
• access to automations
• reports
• templates
• forms

4.2 Extra credits

If the user wants to send more emails than the monthly limit, additional credits can be purchased.

4.3 Price changes

TrendiMail may change prices. Changes will be announced at least 30 days in advance.

5. Payment

Payment is made in advance per month or per year.

If payment is not received, the account may be temporarily blocked.

Invoices are provided digitally.

6. Use of the platform

The user may only use TrendiMail for legitimate and permitted email communication.

It is forbidden to:

• send spam
• use email addresses without valid consent
• use misleading subject lines or senders
• use the platform for phishing, fraud, or illegal activities
• overload or misuse the platform

7. User responsibility

The user is responsible for:

• the accuracy of entered data
• obtaining consent from contacts
• complying with GDPR
• the content of sent emails
• securely storing login credentials

TrendiMail is not responsible for damage caused by incorrect use of the platform.

8. Processing of personal data

8.1 Roles according to GDPR

The user is the data controller for the data of their contacts.

TrendiMail is the processor and processes data solely according to the user's instructions.

8.2 Data processing agreement

This privacy policy and these terms serve as a data processing agreement under GDPR.

9. Availability and maintenance

TrendiMail strives for high availability but does not guarantee 100% uptime.

We may:

• perform maintenance
• implement updates
• resolve errors

If possible, maintenance will be announced in advance.

10. Security

TrendiMail takes appropriate technical and organizational measures to protect data, including:

• encrypted connections
• secure servers
• access control
• monitoring for abuse

11. Liability

TrendiMail is not liable for:

• indirect damage
• loss of revenue
• damage caused by incorrect use of the platform
• damage caused by incorrect user data

12. Termination of account

The user can cancel their account at any time.

TrendiMail may terminate the account in case of:

• abuse
• violation of these terms
• non-payment
• illegal activities

After termination, data will be deleted within 30 days, unless legally required otherwise.

13. Intellectual property

All software, designs, texts, images, and functionalities of TrendiMail remain the property of Trendiwa Netherlands.

The user receives a non-exclusive, non-transferable right of use.

14. Changes to the terms

TrendiMail may change these terms. Changes will be announced at least 30 days in advance.

15. Applicable law

Dutch law applies to these terms. Disputes will be submitted to the competent court in the Netherlands.
